Provides
advice and assistance, as directed by the State Judge Advocate and/or AGR Judge
Advocate, on the day to day legal workload necessary to provide legal services
and support to the staff elements of the Alaska National Guard and subordinate
units, as well as the United States Property and Fiscal Office, with primary
emphasis on providing advice and support on military disciplinary and
administrative matters. Provides
professional legal advice and opinions, both written and oral, on issues
arising from federal laws and regulations or concerning the federally-funded
m! issions of the National Guard. Advises
investigating officers. Revi! ews command
investigations and inquiries, Line of Duty determinations, and other
administrative reports for legal sufficiency.
May serve as a litigation point of contact. Prepares litigation reports,
briefs, pleadings and other papers associated with civil litigation involving
the National Guard. May represent the Alaska National Guard in Administrative
Hearings pursuant to Title VI and Title VII of the Civil Rights Act and other
federal laws applicable to the National Guard of the States. Advises on claims as needed . Upon designation by the State
Adjutant General or State Judge Advocate on the Adjutant GeneralÂ's behalf,
participates as Staff Judge Advocate to the Convening Authority in State
National Guard courts-martial or non-judicial proceedings, and as legal advisor
or counsel in administrative board proceedings. If designated by the State
Judge Advocate, may serve as an Assistant Federal Ethics Advisor for the State National Guard. Reviews contracts, procurement actions and real property matters involving federal funds for
legal sufficiency. Drafts contracts,
agreements and real property documents. Prepares and presents legal training
Statewide as required . Acts as legal assistance officer for members of the National
Guard of the State by providing the following (1) Wills and estates. Provides
legal advice and counseling on wills and estates. Drafts and executes wills and
codicils. Advises on estate planning to include minor tax considerations and
non-trusts under applicable state statues, or refers to private attorneys as
necessary. (2) Prepares complex powers of attorney and other instruments,
insurance matters, general contracts, personal property law, may advise on
advises on immigration/naturalization procedures. Provides for client referrals
to private attorneys as appropriate . (3) Provides advice on rights
accorded by Serviceme! mbers' Civil Relief Act, Uniform Services Reemployment
Rights Act a! nd other laws providing benefits to members of the Alaska National
Guard. (4) Domestic relations/Family Law. Workload permitting, advises on legal
and practical meaning and effects of divorce, legal separations, annulment, and
custody. Refers to appropriate agencies as necessary. (5) Nonsupport and
indebtedness. May advise and counsel on effect and procedures, to include garnishment
rules, repossession procedures, default judgments, adverse personnel actions.
Refers to appropriate agencies as necessary. (6) May advise on Landlord-Tenant
relations and customer affairs, workload permitting. Advises and counsels on
tenant's rights; eviction procedures; the legal effect and meaning of leases,
offers to purchase, sales contracts and customer's rights in dealing with
merchants and lenders; credit reporting agencies; etc. Prepares correspondence
and legal instruments. Coordinates information and activities with other judge advocates to i! nsure effective
communication and utilization of all JAG
officers Coordinates with attorneys at other agencies. May coordinate provision
of defense counsel, to ensure due process rights and proper administration of
military justice. Supervises/coordinates paralegal, legal clerk and other
support staff as needed. Performs other
professional legal and military duties as required.
QUALIFICATIONS REQUIRED:
The incumbent for this position must possess the following minimum requirements:
A. A law degree (LLB or J.D.) from a law school accredited by the American Bar Association.
AND
B. Bar Membership: Be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar, with the demonstrated intent to become a member of the Alaska Bar.

Specialized
Experience: Must
have at least 36 months experience, education or training in the preparation of
cases for trial and/or tries cases before a court or an administrative body of
persons having quasi-judicial power, the rendering of legal advice and services
with respect to questions, regulations, practices or other matters falling
within the purview of a Federal Government, the preparation of interpretive and
administrative orders, rules, or regulations to give effect to provisions of
governing statutes or other law requirements. Skill in analyzing, discussing
and providing oral and written counsel on complex legal arguments in a
representative capacity in a manner that aids the recipient in understanding
the issues, options, and recommended courses of action.
Substitution of Education for Specialized
Experience: One or more of the following accomp! lishments while
in law school may be substituted for not more than one year of experience:
(1) Academic standing in the top one-third of law school graduating
class.
(2) Graduation with academic honors.
(3) Significant participation in the law school's law review.
(4) Significant participation in the law school's moot court
competition.
(5) Significant participation in a clinical legal aid program.
(6) Significant summer law office clerk experience.
(7) Other equivalent evidence of clearly superior achievement.
APPOINTMENT
FACTORS: Excepted/Officer
in the Alaska Army National Guard.
MILITARY COMPATIBILITY: If you are selected for this position, you will be required to become a
member of the Alaska Army National Guard and be assigned to a compatible
military assignment in the following MOS: Officer Branch 27.
INDEFINITE: AKNG perma! nent
technician will retain their permanent status if selected for ! this position,
and may be promoted, reassigned or changed to lower grade if selected for this
position, and will be required to return to their permanent position unless
action is made on a permanent basis. Permanent authorization may not
cross service boundaries, or funding categories, (i.e., ARNG to ANG, or 176 th
WG to 168 th WG). Indefinite employees may be separated with a
30 days notice. Indefinite employees may be converted to permanent
without further competition.
DESIREABLE:
Membership
in the Alaska Bar in Good Standing continuously from application or willingness
and action to become a member of the Alaska Bar.
